Limitation of Liability
Evolution Model Technology and its affiliates shall not be liable for any direct, indirect, incidental, special, consequential or other damages howsoever arising (even if Evolution Model Technology has been advised of the possibility of such damages), whether based in contract (including fundamental breach or breach of a fundamental term), tort (including negligence) or otherwise, resulting from or in any way relating to the use or the inability to use this site, including, but not limited to, damages resulting from (i) incomplete or incorrect information, (ii) software bugs, (iii) computer viruses, (iv) human action or inaction, (v) computer system, phone line, hardware, software or program malfunctions, or (vi) any other error, failure or delays in computer transmission or network connections. All names, logos, trade-marks and service marks contained in this site are owned or licensed by Evolution Model Technology or its affiliates and may not be used without Evolution Model Technology's prior written consent. You acknowledge and agree that the Content may include information (including pricing, ordering and invoice information) pertaining to your company and its business that may be confidential and/or sensitive.
Choice of law
You agree that all matters relating to the access to, or use of, this site shall be governed by the laws of the Province of Saskatchewan and the federal laws of Canada applicable therein, without reference to its conflict of laws principles, and that you will comply with all such applicable laws. Any dispute shall be settled in the courts located in the City of Saskatoon in the Province of Saskatchewan, though the foregoing shall not limit the ability of Evolution Model Technology from seeking injunctions and remedies in other jurisdictions which are required to stop continuing breaches of these Terms by you.
General
These Terms constitute the entire agreement between Evolution Model Technology and you with respect to the subject matter hereof, and supersede all communications, representations, conditions or agreements, either oral or written, between Evolution Model Technology or its affiliates and you with respect to this subject matter. If for any reason a court of competent jurisdiction finds any provision of these Terms or portion thereof to be unenforceable, that provision shall be enforced to the maximum extent permissible so as to effect the intent of these Terms, and the remainder of these Terms shall continue in full force and effect. Evolution Model Technology's failure to insist upon or enforce strict performance of any provision of these Terms or any right shall not be construed as a waiver of any such provision or right. The parties have required that this agreement and all documents relating thereto be drawn up in English.
